2003CVI004655 Franklin County Municipal Court

The judgment was awarded against two individuals for their involvement in a motor vehicle accident.  One of the judgment debtors provided false information to the judgment creditor at an accident scene on private property. 

Our solution: We located a bank account belonging to one of the judgment debtors.  At the garnishment hearing, their attorney successfully vacated the judgment against one of the judgment debtors, effectively quashing the garnishment.  Our next step was to prove lack of liabilty insurance coverage for the remaining judgment debtor, also the owner of the vehicle causing the accident.  We then caused a suspension on the judgment debtor's Ohio Driver's license throught the Department of Motor Vehicles.  Several months later we received a call from the attorney requesting to pay the judgment. 

This case remains perhaps most remarkable as it planted the seeds for Capital Discovery Solutions, a judgment enforcement and process serving company.

2006CVI052201 Franklin County Municipal Court

Judgment against an individual for breach of contract. The judgment creditor contacted our office after they were unsuccessful locating the judgment debtor.
Our Solution: We located the judgment debtor and served him with a subpoena for his appearance at a Judgment Debtor Exam.  We also conducted a parallel investigation indicating the judgment debtor transferred property out of his name around the time of his receipt of the original summons resulting in the judgment against him. The judgment debtor obtained an attorney and effectively postponed the debtor exam.
Once we began applying the badges of fraud to the fact pattern of our investigation, we determined the judgment debtor committed a fraudulent conveyance when transferring property to a known associate, attempting to appear insolvent.  While planning our motion to show cause as to why the real estate transaction should not be immediately reversed through the Ohio Uniform Fraudulent Transfer Act, the judgment debtor's attorney made contact with our office proposing payment and the satisfaction of judgment.

2006CVI047508 Franklin County Municipal Court

Judgment awarded against an Auto Body Shop due to a breach of contract/disagreement over the refurbishing of a classic automobile. The judgment was against the business as well as their principal owners.

Our solution: We located the bank accounts of the judgment debtors. We served the judgment debtors with a subpoena deuces tecum order in tandem with a judgment debtor exam, since our bank levy was not nearly enough to satisfy the judgment. The judgment debtors failed to appear for the debtor exam and warrants were issued for their arrest due to the same. Approximately a week later, the judgment debtor principal business owners were arrested at their place of business for failure to appear in court. Bail was posted, and they were released. The judgment debtors agreed to a periodic payment plan, and made exactly one payment. 

A couple of months later we arrived at the body shop with a locksmith, court bailiff, and a court order authorizing the locking of all entrances and exits from the building, keys to be held by the bailiff. 

Before complete installation of the first lock, we were paid in full and the judgment was satisfied.

The judgment was against an individual for failure to fulfill a rental agreement/contract breach of a storage rental facility. The judgment creditor's attempts at a payment plan and bank levy were unsuccessful.

Our solution: Upon assignment, we located several properties belonging to the judgment debtor. Our challenge was the county, state and federal interest already securing the properties.

Despite successful lien placement by CDS, we were unable to collect after the goverment's priority lien seizure and execution.

We located other properties of interest in multiple counties and secured liens there. This led to our satisfaction of judgment and a large payday for the original judgment creditor.

Judgment for breach of contract. The judgment creditor, through engagement of professional investigative resources, was unable to locate the judgment debtor or their assets.

Our solution: After assignment, we located a professional license in the medical industry held by the judgment debtor.  Not long thereafter, we located their place of employment and successfully satisfied the judgment via garnishment of wages.

Judgment against an individual for breach of contract..  Before contacting us, the original creditor attempted both a wage garnishment and bank levy against the judgment debtor.  

Our solution:  We located the judgment debtor at their new residence in a neighboring county. We determined where they were working and filed another wage garnishment. However the judgment debtor terminated their employment upon learning of the garnishment, and moved again to another county.  Our investigation continued, and not long thereafter we learned of the judgment debtor's relocation to the state of Tennessee, their engagement to marry, and of their intent to purchase land and real estate.  We hustled with our lien placement and the judgment was satisfied.
